Notwithstanding the provisions of Section 35145 of this code and Section 54950 of the Government Code, the governing body of a school district shall, unless a request by the parent has been made pursuant to this section, hold closed sessions if the board is considering the suspension of, or disciplinary action or any other action except expulsion in connection with any pupil of the school district, if a public hearing upon such question would lead to the giving out of information concerning school pupils which would be in violation of Article 5 (commencing with Section 49073) of Chapter 6.5 of Part 27 of this code.

The Board heard the case for appeal in closed session (as per the Brown Act) and will use this time in open session agenda to vote on the appeal.

The Miller Creek Middle School Modernization Site work project includes on-site improvements for the placement of three classroom buildings. On June 4, 2019 the District authorized the award of the agreement upon DSA approval (June 26, 2019) to GCCI, Inc. in the Guaranteed Maximum Price (GMP), not to exceed (NTE) amount of $4,085,091. |

It is recommended by District Administration that the Board of Trustees ratify the Miler Creek Middle School Modernization Site work Lease-Leaseback agreement. |

The Miller Creek Middle School Modernization Project requires determination of CEQA compliance. On January 23, 2019 a Notice of Exemption was filed for the Miller Creek Middle School Project. An amended notice is required to be filed. On July 1, 2019, a proposal was received from Grassetti Environmental Consulting. The proposal was evaluated by administration and Greystone West, the District's construction manager. Grassetti Environmental Consulting's proposal cost is $800.00, and they are more than qualified to provide services on the Miller Creek Middle School Modernization Project. |

It is recommended by District administration that the Board of Trustees approve Grassetti Environmenal Consulting's proposal. |
Proposal for CEQA Services

The project involves the replacement of 16 portable buildings. This work will require the filing environmental documentation in accordance with the California Environmental Quality Act (CEQA) Guidelines. At the recommendation of the CEQA Consultant a categorical exemption is the appropriate level of documentation required for this project as a categorical exemption applies when it can be determined that a project or action is a minor addition that would increase student capacity by no more than 25% as defined in Section 1314 of the CEQA guidelines. |

It is recommended that the Board of Trustees approve the staff to file and record a Notice of Exemption for the Miller Creek Middle School Modernization Project. |

Attached is Resolution No. 2019/20-10 regarding the approval of teaching assignments for the 2019-20 school year. Provisions within the Education Code and Title 5 regulations provide legal avenues for the assignment of certificated employees outside their basic credential document authorization. These options allow local employing agencies the flexibility to assign individuals to teach subjects or provide services other than those authorized by the credential held.
The employees who are being assigned outside the area specified on their credential have completed the sufficient number of units as required by either Education Code Section 44256(b) or 44258.2.
In accordance with findings of the Marin County Office of Education’s assignment monitoring and review, the recommendation is to adopt a resolution as a local assignment option, when needed, for each school year. The district currently has one teacher listed on the resolution. Teachers may complete coursework and testing to become properly credentialed for all assignments. Additional local options may become necessary when the master schedule requires modification to meet the needs of changing enrollment.
This authorization shall be valid for the 2019-2020 school year and may be renewed annually.
